NASHVILLE – The Acting United States Attorney for the Middle District of Tennessee, Thomas J. Jaworski, has announced a settlement with Triumph Hospitality, LLC and A&S Hospitality Management, LLC, the owners and operators of the Garner Hotel in Clarksville, Tennessee. The settlement addresses allegations that the hotel failed to comply with Title III of the Americans with Disabilities Act (ADA) by not honoring a reservation for an accessible room for an individual with a disability.
The agreement stipulates that the Garner Hotel will provide ADA training to its staff, compensate the complainant with $5,000, and pay a civil penalty of $2,000 to the United States. The allegations include the hotel not honoring the reservation for an accessible room and making inappropriate comments about the complainant’s disability status at check-in. Due to the lack of appropriate accommodations, the complainant could not use the shower in the assigned room.
The settlement requires the hotel to implement an ADA-compliant policy, as outlined in the Code of Federal Regulations, specifically 28 C.F.R. § 36.302. The agreement also includes ADA training for staff and financial compensation for the complainant.
Assistant U.S. Attorney Mike Tackeff conducted the investigation and negotiated the settlement. The civil claims resolved by this agreement are considered allegations, with no determination of liability.
