NASHVILLE – Tennessee Attorney General Jonathan Skrmetti has issued a statement following the Sixth Circuit Court of Appeal’s decision to uphold Tennessee’s policy regarding birth certificates. The policy in question dictates that birth certificates in Tennessee record the biological sex of a child at birth, without addressing gender identity.

“Whether someone can change the sex on their birth certificate is a matter for each state to decide,” Attorney General Skrmetti stated. He emphasized that Tennessee has consistently maintained this policy for decades, recognizing birth certificates as a record of biological fact. Skrmetti expressed gratitude that the Court of Appeals concurred with the district court’s decision, affirming that any changes to this policy should be determined by the people of Tennessee.
