On September 8, 2024, Davidson County Chancellor Russell T. Perkins upheld the decision of the Central Tennessee Regional Solid Waste Planning Board to deny BFI Waste System of Tennessee’s application to expand its landfill operations at Middle Point. The decision, originally made on July 9, 2021, was based on evidence that the application was inconsistent with the Central Region’s current Regional Plan.
BFI’s proposal involved constructing a new landfill on a 99-acre site along Jefferson Pike, adjacent to the existing 200-acre Middle Point Landfill near the East Fork of the Stones River. State law mandates that the Regional Planning Board must review and make a decision on such applications before the Tennessee Department of Environment and Conservation (TDEC) can begin its own review.
BFI filed a lawsuit in Davidson County Chancery Court to overturn the Board’s unanimous decision. The City of Murfreesboro joined the lawsuit in November 2021 to represent the interests of local residents.
Mayor Shane McFarland commented on the court’s decision, stating, “The City Council voted to intervene in the lawsuit on behalf of the Regional Board to ensure that the concerns of thousands of Murfreesboro residents were represented and heard. Today’s decision is the latest development in the battle against the construction of a new landfill at Middle Point. It’s a big win for the community. The City will remain steadfastly opposed to any expansion of the landfilling operations at Middle Point.

Tennessee Wins Appeal on Entertainment Act
The U.S. Court of Appeals for the Sixth Circuit ruled in favor of Tennessee in the case of Friends of George’s, Inc. v. Mulroy, supporting the state’s Adult Entertainment Act and dismissing a previous federal district court’s decision to halt its enforcement.
